Good Evening: I will not be attending tomorrow night's hearing as we are packing and to move LDS's office for Friday. In addition, due to health issues with my parents, it is unlikely I will attend meetings in the next few weeks. In any event, here are my comments to 272-12 and 272-12(3): 1) We would like the City to provide a reference and a copy of the plan that the order is referring to and reserve to make additional comments upon such receipt and review. 2) The Woodland Grove Condominium disagrees and emphatically objects to findings 3 and 4 of the proposed board order and ask that the board do the same. While there were some successes over the summer, there also continue to be many failures in the standard operating procedures by the hotel. Every time there is a personnel change, there is a breakdown in procedure and we at the condominium suffer. There has been no consistent success rate at the hotel on parking management and loading management to give us any degree of confidence that the Hotel will implement what is required of them on a regular basis. Furthermore, with the growth of the hotel and potential additional development, it will put increased pressure on the parking capacity at the hotel. With respect to finding 4, the hotel has not operated for many years with" this configuration" as the nature and use of the hotel has changed from a hotel to a hotel and bar with outdoor bar areas which has greatly increased the traffic, deliveries etc. to the hotel. Their licenses for restaurant and bar seats has increased as well since it became Hotel Indigo. 3) We object to finding 6, how can the board make a finding that the existing wireless communications systems are appropriate when we are still waiting to see a plan of the locations along with a narrative explaining what they are? 4) Furthermore, in the event the board order is passed, we request that the ramp and loading area work be required to be completed prior to allowing the hotel their signs and awning. Since the condominium has had little success with enforcement issues with the City and the hotel in the past, we need them to fix the issues at hand first before they are allowed additional privileges. 5) In addition, should the board decide to grant and order, we ask you to require the hotel to fix their ventilation system which has been a nuisance to the condominium since Boxx 109 opened. We have been promised for the better part of three years that the hotel has bought the equipment but not installed it. It is due to the nature of their menu and where the venting is pointed. It is especially bad in the winter when there are no leaves on the trees buffering our building from the smell of burning duck fat. 6) We object to the waiver noted as item (5) on page 2 of 5 of a waiver of twenty additional parking stalls. 7) We express our concern to the statement in finding 10. 8) Condition 17 has no teeth. We ask you to get provide stronger language with assurances for the Riverside development site as to what parking would be permitted, where it would be permitted, and assent from the proper parties who have ownership rights to the area agreeing to such use.
