Docket Item #145-21 Request for Chapter 30 Amendment to establish regulations for gun establishments

HER HONOR THE MAYOR AND COUNCILORS ALBRIGHT, KRINTZMAN, LEARY, OLIVER, GREENBERG, NORTON, LUCAS, KELLEY, WRIGHT, MALAKIE, MARKIEWICZ, GENTILE, DOWNS, CROSSLEY, HUMPHREY, DANBERG, NOEL, BOWMAN, LAREDO, GROSSMAN, BAKER, LIPOF, KALIS AND RYAN requesting amendments to the Newton Zoning Ordinance, Chapter 30, including, but not limited to, the addition of definitions of “Firearm” and “Firearm Businesses”, and amendments to Section 4.4.1 Allowed Uses and Section 6.10 Restricted Uses to regulate the use of land, structures and buildings for the siting and operation of gun ranges or the retail or wholesale operation involving gunsmithing, the purchase or sale of firearms, the sale of ammunition, or firearms accessories, and to restrict such uses to the Business 4, Mixed Use 1, Manufacturing, and Light Manufacturing Districts only and only upon the granting of a special permit, and to establish minimum standards and criteria for the granting of such special permits.

Firearm Zoning – Baker Amendments

Proposed Firearm Zoning Map – Alternative 5: Planning Department’s recommended alternative. Includes the BU2, BU4 and M zones and a 150-foot buffer from residential uses and a 1,000-foot buffer from k-12 schools, all childcare uses, religious uses, parks and playgrounds, colleges and universities, libraries, hospital, and nursing homes.

Proposed Firearm Zoning Map-Alternative 6 (5/27/2021) – the same map as Alternative 5, however a 1,000 foot buffer has been applied to conservation areas and sensitive uses outside of the City of Newton are included in the buffers. This map is also the same as Baker Amendments #4 and #5 combined. 

Proposed Firearm Zoning Map – Baker Amendment #4 (6/2/2021) – the same map as Alternative 5, however a 1,000 foot buffer has been applied to conservation areas.

Proposed Firearm Zoning Map – Baker Amendment #5 (6/2/2021) – the same map as Alternative 5, however the buffers from sensitive uses have been extended to those uses located outside of the City of Newton’s borders (does not include conservation areas).

Proposed Firearm Zoning Map – Alternative 1: includes the BU2, BU4, M, LM, and MU1 zoning districts and a 150-foot buffer from residential uses, a 1,000-foot buffer from k-12 schools, and a 500-foot buffer from all childcare uses, religious uses, parks and playgrounds, colleges and universities, libraries, hospital, and nursing homes.

Proposed Firearm Zoning Map – Alternative 2: the same map as Alternative 1, however the BU2 zoning district has not been included

Proposed Firearm Zoning Map – Alternative 3: the same map as Alternative 1, however a 500-foot buffer around marijuana retailers and establishments with a liquor license has been included

Proposed Firearm Zoning Map – Alternative 4: the same map as Alternative 1, however a 250-foot buffer has been applied to residential uses instead of 150 feet
